AV Calculator
Terms of Use
Last updated: 2026-09-30
1. Agreement. These terms govern your use of the Basirix AV Calculator (the “Calculator”) at basirix.com/av, provided by Basirix, LLC (“Basirix,” “we”). By using the Calculator, you agree to these terms. If you do not agree, do not use it.
2. What the Calculator is. The Calculator is a free tool that estimates and compares the actuarial value of health plan designs. It is based on the publicly available methodology and continuance tables of the Centers for Medicare & Medicaid Services (CMS) AV Calculator. Results are estimates built from a short list of inputs you provide, plus disclosed default assumptions. They reflect in-network cost-sharing and the plan year stated with the results. Out-of-network cost-sharing is not modelled. For some plan designs the Calculator will decline to return a value rather than estimate one.
3. Not professional advice. The Calculator is for general information and comparison only. It does not provide actuarial, legal, tax, insurance, or benefits advice, and it does not replace advice from a qualified actuary, attorney, tax advisor, or benefits professional. Do not rely on it as the sole basis for any plan design, purchasing, pricing, compliance, or employment decision. This includes the HSA eligibility check, which is an estimate and not tax advice.
4. Not certified; not for regulatory use. Results are not certified or filed actuarial values. They must not be used for regulatory filings, metal-level determinations, or any purpose that requires a certified actuarial value. Official determinations are made using CMS’s own calculator.
5. No affiliation with CMS. Basirix is not affiliated with, endorsed by, or sponsored by CMS or any government agency. References to CMS describe the source of the methodology only.
6. Your responsibility. You are responsible for the accuracy of what you enter, for checking results against the plan’s official documents, and for any decision you make using the Calculator. Your actual costs depend on the care used and the plan’s full terms.
7. Information you enter. Enter plan design information only. Do not enter protected health information or personal information about any individual. The inputs you submit are processed to produce results as described in our Privacy Policy, which applies to your use of the Calculator.
8. Acceptable use. You agree not to: use automated means to access the Calculator at volume, or to scrape or copy its outputs systematically; interfere with or overload the service; reverse engineer it, except where the law expressly permits; or present its results as certified, as endorsed by Basirix, or as advice from Basirix.
9. No warranties. The Calculator is provided “as is” and “as available,” without warranties of any kind, express or implied. This includes warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that it will be error-free, uninterrupted, or current with any change in CMS methodology or law.
10. Limitation of liability. To the fullest extent permitted by law, Basirix and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising from your use of or reliance on the Calculator, even if advised that such damages were possible. Our total liability for any claim relating to the Calculator will not exceed US$100. Some jurisdictions do not allow certain of these limits, so they apply to you only to the extent the law allows.
11. Indemnity. You agree to indemnify and hold Basirix harmless from claims arising from your misuse of the Calculator or your breach of these terms, including presenting its results to others as certified or as professional advice.
12. Changes. We may change, suspend, or discontinue the Calculator, or update these terms, at any time. The “Last updated” date shows when these terms last changed. Continued use after a change means you accept the updated terms.
13. Governing law. These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in the State of Wyoming.
14. Contact. Questions about these terms: support@basirix.com.
